AIReel Terms of Service

Effective Date: September 24, 2026
Last Updated: September 24, 2026

These Terms of Service (the "Terms") are an agreement between you and FunCreate LIMITED ("AIReel," "we," "us," or "our"). They apply to your access to or use of the AIReel mobile application, website, web interface, and related features, content, products, and services (collectively, the "Services").

By accessing or using the Services, creating an account, submitting content, purchasing a subscription or credits, or selecting an acceptance button, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

1. Eligibility and Regional Requirements

The Services are intended for people who are at least 16 years old. You must not access, register for, or use the Services if you are under 16. You must also meet any additional legal-capacity or consent requirements applicable where you live. You must provide accurate information when requested.

In Brazil, the Services are available only to people who are at least 18 years old. People under 18 in Brazil may not access, register for, or use the Services.

If we learn or reasonably believe that you do not meet an applicable age or consent requirement, we may suspend or terminate the relevant account and delete related information and content as permitted or required by law.

2. Services and Regional Availability

AIReel provides AI image and video generation, editing, transformation, and related creative features. Depending on the feature you choose, we may use third-party AI services, including but not limited to Kling AI, Vidu, Seedance, Wan, Hailuo AI, and Grok, to process your request.

The Services may not be available in every country or may offer different features, prices, payment methods, or content rules by country or region. You are responsible for ensuring that your use of the Services complies with the laws and rules that apply where you access them.

We may provide the Services through different versions or interfaces for the App and Web. A feature, permission, payment method, or setting available on one platform may not be available on another platform.

3. Accounts and Account Security

Some features require an account. You are responsible for providing accurate and current registration information and for keeping your password, verification codes, and other login credentials confidential. You are responsible for activity under your account unless the activity resulted from our failure to maintain reasonable security.

You must promptly notify us at aireel.feedback@gmail.com if you believe that your account or credentials have been accessed without authorization. You may not sell, transfer, lend, or share your account except where we expressly allow it.

4. License to Use the Services

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Services for their intended purposes. This license does not transfer ownership of the Services or any AIReel technology, model, software, design, trademark, or other intellectual-property right to you.

Except as permitted by law or expressly authorized by us, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, scrape, mirror, interfere with, or create derivative works from the Services or their underlying technology.

5. App Permissions, Updates, and Device Features

The App may provide updates, bug fixes, security patches, or other changes. Your device or app-store settings may allow updates to be installed automatically. Web features may change when we update the Web interface or supporting systems.

Depending on the feature, the App or Web interface may ask you to provide access to photos, videos, camera, files, or other device resources that you choose to use for uploading, editing, generating, exporting, or saving content. You can manage App permissions through your device settings. If you do not grant a permission, the relevant feature may not work.

6. AI Features and Generated Content

AI-generated content may be inaccurate, incomplete, similar to content generated for other users, biased, unavailable, or unsuitable for a particular purpose. We do not guarantee that generated content is unique, accurate, non-infringing, legally protectable, or suitable for publication or any particular use. You should review generated content before using, publishing, distributing, or otherwise relying on it.

You are responsible for your prompts, inputs, generated content, and the consequences of publishing, distributing, using, or commercializing them. Nothing in these Terms guarantees that your User Content or generated content is free from third-party rights or that it can be used for every purpose.

You must not present AI-generated content as authentic human-created material, factual evidence, or an endorsement by a real person or organization when doing so would mislead others or violate law. You must follow any applicable disclosure, labeling, advertising, platform, or community rules when sharing or using generated content.

7. User Content

"User Content" means prompts, text, images, videos, audio, files, materials, project data, feedback, and other content that you upload, submit, create, edit, save, or otherwise provide through the Services, including content submitted as input and content generated through the Services.

You retain the rights you have in your User Content. You represent and warrant that you have the rights, permissions, and lawful basis needed for us and our service providers to process your User Content as described in these Terms and the Privacy Policy.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, adapt as technically necessary, process, moderate, and display your User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, support, and improve the Services, comply with law, and enforce these Terms. We may sublicense these rights to service providers acting on our behalf, including hosting, moderation, payment, and AI processing providers. This license ends when the relevant processing purpose ends, except for limited copies retained as required for security, legal compliance, dispute resolution, or backup and recovery processes.

We do not use your prompts, uploaded materials, or generated content to train, retrain, or fine-tune foundational AI models unless we separately obtain your explicit consent or clearly disclose otherwise. We do not publicly display your User Content by default. We will not use your User Content for advertising or promotional materials unless you separately consent or direct us to do so.

8. Content Restrictions and Prohibited Conduct

You may not use the Services or generated content to:

We may publish additional content or community rules for particular features. Those rules form part of these Terms when made available to you.

9. Content Review, Enforcement, and Appeals

We may use automated systems and, where reasonably necessary, limited human review to detect abuse, review content for safety and legal compliance, respond to support requests, maintain service reliability, and enforce these Terms.

We may reject, restrict, remove, or disable access to User Content, features, accounts, or transactions where we reasonably believe that this is necessary to comply with law, protect users or the Services, prevent abuse, or address a breach of these Terms. Depending on the circumstances, we may provide notice and an opportunity to appeal.

If your content is blocked or your account is restricted, you may contact aireel.feedback@gmail.com with the relevant account information and an explanation. We may request information needed to review the appeal.

10. External Sharing and Public Visibility

Your User Content and generated content are not publicly displayed by default. If you choose to publish, export, or share content through a third-party platform, you are responsible for ensuring that the content and your sharing activity comply with applicable law, third-party rights, and the rules of that platform.

Sharing content does not give you rights in third-party materials, trademarks, public-figure likenesses, music, footage, or other protected elements included in that content. You must obtain any permissions required for your intended use.

11. Paid Services, Subscriptions, and Credits

The Services may include subscriptions and credits. Credits may be used to submit requests for AI-generated images, videos, or other AI works. Credits have no cash value, are not legal tender, and may be used only within the Services. The applicable price, currency, billing cycle, number of credits, credit validity, subscription benefits, trial terms, and other purchase terms will be shown before you complete the purchase.

Web purchases may be processed through Stripe, including payment methods supported by Stripe such as Google Pay. Android App purchases may be processed through Google Play. The relevant payment platform may process payment details under its own terms and privacy policy. We generally receive order, subscription, transaction, and payment-status information rather than your complete payment-card credentials.

If you purchase an auto-renewing subscription, it will renew for the selected period unless you cancel it before the next renewal under the management rules of the relevant payment platform. Web subscriptions must be managed through the applicable account or payment-management interface associated with the Web purchase. Google Play subscriptions must be managed through your Google Play account. Uninstalling the App does not necessarily cancel a subscription.

Charges, refunds, cancellation deadlines, failed payments, taxes, and consumer rights are subject to applicable law and the rules of the relevant payment platform. Nothing in these Terms limits a non-waivable refund or cancellation right. If you believe you were charged in error or a paid feature failed, contact aireel.feedback@gmail.com promptly and include the relevant order information.

Credits may not be sold, transferred, exchanged for cash, or used outside the Services. Credits may be consumed according to the generation feature, model, output settings, and rules shown in the Services. We may change or discontinue a paid feature, but we will provide any refund or other remedy required by applicable law. We may restore credits or provide another reasonable remedy where a generation request is not completed because of a confirmed Service failure, subject to the applicable feature rules and applicable law.

12. Third-Party Services

The Services may depend on or link to third-party services, including AI processing, cloud hosting, payment, login, analytics, advertising, social-sharing, and app-store services. Third-party services are controlled by their respective providers and may be governed by separate terms and privacy policies. We are not responsible for a third party's independent service, content, policies, or acts, except to the extent applicable law provides otherwise.

13. Feedback

If you provide suggestions, ideas, reports, or other feedback about the Services, you agree that we may use it without restriction or compensation to you, provided that we do not use it to identify you or disclose your private User Content except as described in the Privacy Policy.

14. Service Changes, Suspension, and Termination

We may add, change, suspend, or discontinue all or part of the Services for operational, technical, security, legal, or business reasons. We will take reasonable steps to provide notice of material changes where appropriate.

We may suspend or terminate your access, remove content, cancel transactions, or take other proportionate measures if we reasonably believe that you violated these Terms, created a security or legal risk, infringed rights, abused a paid feature, or used the Services unlawfully. We may also act without prior notice where immediate action is necessary to protect users, the public, or the Services.

You may stop using the Services and request account deletion through the available account controls or by contacting aireel.feedback@gmail.com. Account deletion will remove the account, projects, generated content, and uploaded materials, subject to data that we must retain for legal, financial, security, fraud-prevention, dispute-resolution, or other lawful purposes.

15. Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not promise that the Services or generated content will be uninterrupted, error-free, secure, accurate, complete, timely, available in every location, or suitable for your particular needs.

The Services and generated content do not constitute legal, medical, financial, investment, safety, or other professional advice. You should obtain appropriate professional advice where necessary.

16. Limitation of Liability

To the maximum extent permitted by law, FunCreate LIMITED and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunity, or data, arising from or related to the Services or these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, deliberate misconduct, or other mandatory liability under applicable law. To the extent a liability cap is permitted by law, our total liability for a claim relating to the Services will not exceed the amount you paid to us for the relevant Services during the 12 months before the event giving rise to the claim, or USD 15 if you paid nothing.

17. Your Responsibility for Third-Party Claims

To the maximum extent permitted by applicable law, you are responsible for claims, losses, liabilities, and reasonable costs arising from your User Content, your use of the Services, your violation of these Terms, or your infringement of another person's rights. This section does not require you to indemnify us for losses caused by our own fraud, willful misconduct, or non-waivable legal obligations.

18. Intellectual-Property Complaints

For an intellectual-property complaint, contact aireel.feedback@gmail.com and provide, where possible, your contact information, proof of the rights claimed, the location of the relevant content, an explanation of the alleged infringement, and a statement that the information is accurate and that you are authorized to submit the complaint.

19. Changes to These Terms

We may update these Terms to reflect changes in the Services, technology, law, or business operations. For material changes, we will take reasonable steps to notify you through the Services, email, or another appropriate method. The updated Terms will take effect on the stated effective date. Your continued use after that date means that you acknowledge the updated Terms. If you do not agree, stop using the Services and request account closure.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules, except to the extent mandatory consumer-protection law in your country requires otherwise. The courts of Hong Kong will have jurisdiction, subject to any mandatory right you may have to bring a claim before the courts of your place of residence or another competent authority.

21. General Terms

We may assign these Terms as part of a merger, reorganization, sale of assets, or transfer of the Services, subject to applicable law. You may not assign your rights or obligations without our prior written consent.

If a provision is held invalid or unenforceable, it will be limited or replaced to the minimum extent necessary, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any purchase-specific terms shown before a transaction form the agreement between you and us concerning the Services.
